Actuel PC – Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions govern the supply of goods and services by Actuel PC Pty Ltd (ACN 696403415, ABN 14696403415), trading as Actuel PC.

By using our website, purchasing products, joining a membership, subscribing to a product subscription, or entering a promotion, you agree to these Terms.

Actuel PC may update these Terms from time to time. The updated version takes effect when published on the website.

2. Privacy

Actuel PC handles personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

We collect and use personal information to process orders, manage memberships and subscriptions, apply discounts, allocate promotional entries, verify eligibility, conduct draws, contact winners, fulfil prizes, prevent fraud, provide customer support, and comply with legal obligations.

3. Nature of Our Business

Actuel PC is a Queensland-based online retailer selling:

• Gaming apparel

• PC and desk accessories

• Collectibles and related products

• Custom and prebuilt gaming PCs

We also offer:

• Memberships that provide real retail benefits

• Product subscriptions that deliver physical products each month

• Promotional giveaways from time to time as a marketing activity

Core principle: Money buys real products and real retail benefits. Money does not directly buy promotional entries. Promotional entries arise only from qualifying physical product purchases during an active promotion.

4. Memberships

Membership fees are charged for the retail benefits listed below. Memberships do not generate promotional entries simply by existing or renewing.

Mythic – $85.99 per month

• Up to $60 off one eligible item of your choice per month, then 15% off other eligible Actuel store products

• Ability to select one eligible product from the store each month

• Free shipping storewide

• Early access and premium perks

• Event invites and community updates

• Cancel anytime

Memberships renew automatically each month unless cancelled. You may cancel at any time through your account. No refund is provided for the remaining period of a cancelled membership, except where required by law.

5. Product Subscriptions and Mystery Products

Actuel PC may offer monthly product subscriptions (including Gear Drop and mystery boxes).

These subscriptions deliver one or more physical products each billing cycle. The exact contents will be described on the product page at the time of purchase or renewal.

Subscription fees are charged for the physical products supplied. You may cancel future deliveries at any time before the next billing date.

Mystery and Random Products

Some products (including Funko Bitty Pops, Deddy Bears, Kreepy Collectibles, and other mystery or blind-box style items) are supplied randomly.

• Specific characters or variants cannot be chosen or requested.

• Duplicate items (doubles) may occur.

• Rare or chase variants are not guaranteed.

• Actuel PC cannot accept returns or exchanges solely because a customer received a duplicate or a character they already own, except where required by the Australian Consumer Law (for example, if the product is faulty).

By purchasing a mystery or random product (including as part of a subscription), you accept that the item is selected at random and that doubles are possible.

6. Promotional Entries and Giveaways

From time to time, Actuel PC may run promotional giveaways (including custom PCs, hardware, and other prizes) to promote our products and community.

Promotional entries are awarded only for eligible product purchases made during an active promotion.

• Memberships themselves do not generate promotional entries.

• The physical product delivered as part of a product subscription is treated as a normal product purchase and may carry promotional entries.

• Active members receive double entries (x2) on one eligible product per calendar month only.

• Any further eligible products purchased in the same month receive single entries.

• Non-members receive single entries on all eligible products.

• Entries are free, have no cash value, cannot be purchased separately, and cannot be transferred or sold.

The exact number of entries, eligibility rules, and any other limits will be stated in the terms of each individual promotion.

7. Store Discounts

Membership discounts apply only to eligible products during an active membership.

Discounts may exclude limited items, already discounted products, shipping, Printful products, third-party fulfilled products, custom builds, or any other products stated on the website.

Discounts cannot be exchanged for cash or used after the membership ends.

8. Promotion Eligibility

Unless otherwise stated in a specific Promotion, entry is open to Australian residents aged 15 years or older (with parental consent if under 18).

Actuel PC may exclude residents of certain states or territories where legal or operational requirements prevent the promotion from running.

Employees, contractors, directors, officers, agents, and their immediate family members may be excluded.

Actuel PC may require proof of identity, age, address, and eligibility before confirming a winner or awarding a prize.

9. Draws and Winner Selection

Each promotion will have a clear entry deadline. Only valid entries recorded before the deadline will be included.

Winners will be selected by random draw from all valid eligible entries. Draws may be conducted live or by another fair method stated in the promotion terms.

Actuel PC may disqualify any person who tampers with the entry process, provides false information, uses multiple accounts, or breaches these Terms.

If a winner cannot be contacted, does not respond within a reasonable time, is found ineligible, or refuses the prize, Actuel PC may redraw.

By entering a promotion, participants consent to the publication of their name, suburb, and state where required by law or the promotion terms.

10. Accounts and Website Use

You must provide accurate and current information when creating an account or making a purchase.

You are responsible for keeping your login details secure. Actuel PC may suspend or terminate an account if we reasonably suspect fraud, misuse, payment issues, or breach of these Terms.

11. Consumer Rights and Returns

Nothing in these Terms limits your rights under the Australian Consumer Law.

For minor faults we may offer repair, replacement, or refund as permitted by law. For major faults you may be entitled to a refund, replacement, or compensation in accordance with the Australian Consumer Law.

We do not offer refunds for change of mind, incorrect size selection, or buyer’s remorse, except where required by law.
 

12. Printful and Third-Party Fulfilled Products

Some apparel, desk mats, and accessories are produced and shipped by third-party suppliers (including Printful).

Because these products are often made to order, we generally do not accept change-of-mind returns unless required by law.

If a third-party fulfilled product arrives damaged, defective, or incorrect, contact us promptly with photos and order details so we can assess the issue.
 

13. Prizes

Prizes are promotional prizes and are not sold to the winner.

Unless stated in the specific promotion terms, Actuel PC does not provide a separate commercial warranty on prize items. Any manufacturer warranty and your non-excludable rights under the Australian Consumer Law still apply.

Actuel PC may substitute a prize of similar type and equal or greater value if the advertised prize becomes unavailable.
 

14. Changes to Law, Promotions or Business Model

Actuel PC may amend, suspend, or modify memberships, subscriptions, promotions, entry rules, or these Terms where required for legal, regulatory, operational, or business reasons.

 

15. Liability
To the maximum extent permitted by law, Actuel PC excludes liability for any indirect or consequential loss arising from the use of the website, purchase of products, memberships, subscriptions, or participation in promotions.

 

16. General 
If any part of these Terms is found to be invalid, the remaining parts continue to apply. These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
